The petitioner seeks bail in Silao P.S. Case No.224 of 2018 registered under Sections 25(1-b)a, 26, 35, 25, 1(AA) of the Arms Act.
The informant got information that Manoj Kumar, son of Sahdeo Mahto of village Nanand P.S. Silao was dealing in illegal arms and the informant raided the house of Manoj Kumar in order to verify the information and recovered loaded arms, magazine and Rs.5,10,200/-. Manoj Kumar is said to have disclosed the name of other accused persons who are his accomplices in dealing of arms.
The learned counsel for the petitioner submits that name of the petitioner was disclosed by Manoj Kumar but nothing has been recovered from the possession of the
Patna High Court Cr.Misc. No.75730 of 2018(2) dt.18-12-2018 2/2 petitioner. Similarly situated co-accused Rahul Kumar has been granted bail by the learned Sessions Judge vide order passed in B.P. No.1631 of 2018. The case of the petitioner stands on the same footing.
Considering the fact that save and except the disclosure made by Manoj Kumar, no tangible material is collected against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif, District-Nalanda in connection with Silao P.S. Case No.224 of 2018.
