The petitioner apprehends his arrest in connection with Tariyani P.S. Case no. 40 of 2019, registered under Sections 307, 323, 324, 341, 379, 427 and 504/34 of the Indian Penal Code.

The accusation is that petitioner and seven others named in the F.I.R. were removing bricks of the road then informant made protest, whereupon, the petitioner gave sword blow at his head, when Charitra Sah, Bhusan Kumar and Krishna Sah rushed to save the informant then Charitra Sah, Bhushan Kumar and Krishna Sah were also assaulted. At that time, cash of Rs. 2000/- and golden chain was also snatched from the person of the informant.

Patna High Court CR. MISC. No.26112 of 2019(2) dt.23-04-2019 2/2 Learned counsel for the petitioner submits that the injuries found on the person of the informant and two others are simple in nature. Moreover, while the allegation has been made against the petitioner to cause sword injury to informant, but the injury found on the person of informant is simple in nature caused by hard and blunt substance. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 40 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
