JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Sursand P.S. Case No. 39 of 2017 for offence under Section 341,323,324,307,354,427 and 504/34 of the Indian Penal Code. Accusation is that the informant Ramdev Mandal was repairing his house at that time, the petitioner no. 1 came there and prohibited to construct the house and started abusing and assaulting the informant and his family members along with other co-accused persons. On account of which the informant, his wife and two sons sustained injuries, thereafter, the petitioners also
Patna High Court Cr.Misc. No.24157 of 2017 (3) dt.06-09-2017 2/2 poured water on cement packets to damage worth Rs. 25,000/-. Learned counsel appearing on behalf of the petitioners submits that due to land dispute the occurrence took place in which the petitioner no. 5 also sustained head injury, whereas, injuries sustained by the informant and his two sons are found simple in nature. He further submits that the present case is counter-case of Sursand P.S. Case No. 38 of 2017 lodged by coaccused Shiv Dulari Devi against the informant and his family. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the even of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Pupari at Sitamarhi in connection with Sursand P.S. Case No. 39 of 2017 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
