Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench.
The petitioner apprehends his arrest in a case registered for the offence punishable under section 7 of the E.C. Act. Allegedly, the petitioner is said to be involved in the illegal storage and black-marketing of Government sponsored food grains in the Balaji Flour Mills. The petitioner is the proprietor of the said mill.
Patna High Court CR. MISC. No.23568 of 2022(2) dt.25-08-2022 2/3 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to enmity and grudge. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. His name transpired in the present case on the basis that the said food supplies belongs to Bihar State Food Corporation. The petitioner purchased 400 old bags of supplies at the cost of Rs.12 per bag from P.D.S. dealer which is also evident from annexure-5 of the bail application. The said mill is registered having valid license and G.S.T. number. The petitioner has license for dealing in goods such as rice and wheat or meslin flour. The bill of supply is also enclosed in annexure-3 and 4 of the bail application. Petitioner has no criminal antecedent, as also mentioned in para-3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of
