The petitioner seeks bail in Piro P.S. Case No.73 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act and under Section 420 of the Indian Penal Code. The police intercepted a Wagon R Car bearing Registration No. BR-01BE/8527 and apprehended three persons, namely, Arvind Kumar Singh, Rajiv Kumar @ Lala, the petitioner, and Ajay Kumar sitting inside the vehicle. 259 litres of foreign liquor of different brands was recovered from the vehicle.

Learned counsel for the petitioner submits that the petitioner was arrested on 17.03.2020 and since then he is in

Patna High Court CR. MISC. No.25857 of 2020(2) dt.13-10-2020 2/2 custody. Ajay Kumar has already been enlarged on bail by a coordinate Bench of this Court vide order dated 24.08.2020, passed in Cr. Misc. No.22323 of 2020. The case of the petitioner stands on the same footing.

Having regard to the facts that similarly situated coaccused, namely, Ajay Kumar has already been enlarged on bail and the petitioner is in jail for about seven months, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned IVth Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur, Ara in connection with Piro P.S.
