Petitioner apprehends his arrest in connection with Matihani P.S. Case No. 74 of 2015 registered under Sections302, 201, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.
The allegation against the petitioner is that he alongwith other accused persons killed the son of the informant and his friend and thrown the dead bodies in river Ganga. Learned counsel for the petitioner submits that the deceased and the accused Vicky Mishra had land dispute between them and they were on inimical terms. Petitioner is not named accused.
Patna High Court Cr.Misc. No.40758 of 2016 (5) dt.12-01-2017 2/2 Considering the nature of allegations levelled and the fact that charge-sheet has already been submitted against co-accused Vicky Mishra, I do not find it to be a fit case to grant the privilege of anticipatory bail to the petitioner.
