09-01-2019 Heard Sri Tej Narayan Singh, learned counsel for the petitioner and Sri Umeshanand Pandit, learned Addl. Public Prosecutor.
This is 2nd attempt for grant of bail on behalf of the petitioner. The petitioner's prayer for bail was earlier rejected on 04-05-2018, vide Cr. Misc. No. 26915 of 2018. While dismissing, liberty was granted to renew the prayer for bail after completion of nine months in custody.
Learned counsel for the petitioner submits that petitioner is in custody since 31-01-2018 and has completed more than 11 months.
Learned Addl. Public Prosecutor has opposed the prayer.
However, considering the nature of accusation as well
Patna High Court Cr.Misc. No.76872 of 2018(2) dt.09-01-2019 2/2 as period of custody and earlier observation, let the petitioner namely Sinku Chauhan be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Kaimur at Bhabua in connection with Kudhani P.S. Case No. 01 of 2018.
