This is 2nd attempt for grant of bail on behalf of petitioner in Barauni P.S. Case No. 266 of 2019, registered from the offence under Sections 302, 120(b) and 34 of the I.P.C. Earlier, vide order dated 23-01-2020 passed in Cr. Misc. No. 74972 of 2019, the prayer for bail of petitioner was rejected with observation to renew the prayer for bail after framing of charge.

In this regard, vide order dated 09-09-2020, a report was called for from the court below regarding stage of the case, which has been received and kept at flag 'A'. From perusal of report dated 06-10-2020 of learned Chief Judicial Magistrate I/c, Begusarai, it appears that charge has not been framed as yet.

Patna High Court CR. MISC. No.23214 of 2020(3) dt.02-11-2020 2/2 Only cognizance has been taken and case is pending for appearance.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The bail application of petitioner again stands rejected. (Prabhat Kumar Singh, J.) anay/- U T
