JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Complaint Case no. 1424 of 2014, registered under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of torturing of the complainant/O.P. No.2 by her husband and other in-laws due to non-fulfillment of demand of dowry and removing her from matrimonial house and snatching her personal belongings.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.24306 of 2017 (3) dt.12-09-2017 2/2 petitioners are in-laws of the complainant, but no specific overt act has been attributed against the petitioners. There is general and omnibus allegation against them to demand of dowry and removing her from matrimonial house.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Complaint Case No. 1424 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
