The petitioner is accused in connection with Hajipur Sadar P.S. Case No. 80 of 2016 registered under Sections 395 and 397 of the Indian Penal Code and later on Section 412 of the Indian Penal Code has been added.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation in the present case, petitioner was apprehended by the police with firearms and accordingly, Hajipur Sadar P.S. Case No. 106 of 2016 was instituted against him. Thereafter, the police got recorded the confessional statement of the petitioner showing the recovery of Rs.32,000/- as looted from the Bank and thereafter

Patna High Court Cr.Misc. No.1505 of 2017 (2) dt.17-01-2017 petitioner has been remanded in the present case on 29.04.2016 since then he is in custody. It is further submitted that while the petitioner is accused in three other cases, but in all cases, he is on bail.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 80 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
