This is a petition for grant of anticipatory bail for offence under Sections 399 and 402 of the Penal Code.

The prosecution case is that the police, on secret information, raided and arrested Md. Firoz and Md. Tarim and the name of the petitioner finds place in the confessional statement of Md. Firoz. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten

Patna High Court Cr.Misc. No.39936 of 2014 (2) dt.22-04-2015 2/2 thousand) with two sureties of the like amount each in connection with the Tatarpur P.S. Case No. 541 of 2014 (G.R. No. 2861 of 2014) to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, subject to the conditions laid down under Section 438(2) of the Criminal Procedure Code and the petitioner shall not indulge in such activity further and if he indulges, then, the deponent must inform the Court about the indulgence of the petitioner and the Court below, itself, shall proceed to cancel the bail bond of the petitioner.
