The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 323, 325, 307 and 504/34 of the Indian Penal Code. It is alleged that four accused persons entered into the house of the informant and started abusing when protest being made co-accused Binda Chouhan assaulted with lathi to the informant. When the brother of the informant came to rescue then this petitioner assaulted with lathi on his head and other parts of the body, when wife and brother's wife of the informant came to rescue they were also assaulted by Kapil Chouhan and Shankar Chouhan and this petitioner snatched ear-ring of the

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. Suryadeo Yadav the brother of the informant received three injuries, out of which two have been found to be simple in nature, though, one injury on the parietal region has been found to be grievous and other co-accused have been granted anticipatory bail vide Cr. Misc. No. 19754 of 2015. Considering the fact that the assault was made in the background of land dispute, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Buniyadganj P.S. Case No. 131 of 2014 pending in the court of learned Chief Judicial Magistrate, Gaya.

With the aforesaid observation, this application is disposed of.
