JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 20(b) of the N.D.P.S. Act. 2.2 Kgs of ganja was recovered allegedly from the house of the petitioner.

Petitioner is in custody since 01.08.2016.

Petitioner has stated on oath that he has got no criminal antecedent. The report of the Court-below also reveals that the petitioner has got no criminal antecedent.

In stead of detailed investigation of the case a prosecution report has been filed in perfunctory manner. In the circumstances, let petitioner, above named, be enlarged on bail on
