2. The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No. 208 of 2024, registered for the offences punishable under Sections 376, 511/34 of the IPC.
3. The informant alleged that on 07.03.2024, the petitioner and co-accused attempted to outrage her modesty in a brinjal field and threatening to kill her when villagers arrived.

The learned counsel for the petitioner has submitted that the victim stated in her written report that the occurrence took place in a brinjal field, whereas in her statement recorded under Section 180 of the BNSS, she has stated that the accused persons outraged her modesty in a wheat field. It has further been submitted that no cogent reason has been explained for the delay of seven days in lodging of the FIR.

5. On the other hand, learned APP for the State has opposed the prayer for bail.
6. There is no cogent reason for the delay in lodging of the FIR and there is a contradiction between the statement of the victim mentioned in the written report and her statement recorded under Section 180 of the BNSS.

Considering the above-mentioned facts and circumstances, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Gopalganj Town P.S. Case No. 208 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
