Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.
Petitioners are ladies and the present occurrence appears to have taken place on account of childish quarrel. Moreover, there is general and omnibus allegation against these petitioners that they also participated in assaulting the deceased and injured persons of this case but the petitioners have been
Patna High Court Cr.Misc. No.38747 of 2016 (2) dt.20-09-2016 2/2 shown unarmed at the time of alleged occurrence in the ferdbeyan of the informant whereas other accused were carrying weapons in their hands.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are languishing in jail custody since 08.06.2016, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati at Gaya in connection with Dumaria P.S. Case No. 40 of 2016.
