JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-10-2020 Heard Mr. Ratanakar Jha, learned counsel for the petitioner and Mr. Jharkhandi Upadhyaya, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Madhubani Town PS Case No. 253/2018 registered for the offence punishable under Section 120B, 188, 363 and 365 of the IPC.

3. The allegation against the petitioner as per First Information Report is that on 12.07.2018, during inspection, a girl was found missing from Balika Grih, in which the petitioner was posted as a Security Guard.

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

No.24408 of 2020(3) dt.07-10-2020 2/2 and she has falsely been implicated in this case merely on the basis that petitioner being Security Guard of the said Balika Grih, was negligent in her duty and had gone to sleep upstairs. Learned counsel further submits that petitioner has remained in custody since 09.08.2018 for about two years.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner has remained in custody since 09.08.2018, accordingly, I am inclined to grant regular bail to the petitioner.

6. Accordingly, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town PS Case No. 253/2018.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
