====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2025 Despite valid service of notice, nobody appears for opposite party no.2. Heard learned counsel for the petitioner and the State.

2. Petitioner seeks regular bail in connection with Murliganj P.S. Case No. 376 of 2022 registered under Sections 341, 323, 354(D), 504, 506/34 of the Indian Penal Code, Sections 66, 67 of the I.T. Act as well as Sections 7 and 8 of the POCSO Act.

3. Allegation against the petitioner is of molestation of minor daughter of the informant and to make her photo viral on social media. It is further alleged that when victim protested, petitioner pointed pistol towards her.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Parties are neighbourers and there was love affair between the petitioner and the daughter of the informant and to satisfy ego, informant has filed this false case against the petitioner. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 12.9.2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act, Madhepura in Murliganj Police Station Case No. 376 of 2022.
