The petitioners apprehend their arrest in connection with Bachhwara P.S. Case No. 126 of 2012 registered under Section 366/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the complainant-informant by the petitioners and Satiya Devi and sold her to Shimla Devi.

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case mere on suspicion, in fact, victim, daughter of the informant has stated in her statement recorded under Section 164 Cr.P.C. that she was

Patna High Court CR. MISC. No.20529 of 2019(6) dt.05-08-2019 2/2 kidnapped and sold by her aunt Silwa Devi and her aunt and maternal aunt assaulted her but did not disclose the name of these petitioners having their hand in her kidnapping and she was recovered by the police.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Bachhwara P.S. Case No. 126 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
