The petitioner is apprehending his arrest in connection with Bettiah Town (Kalibag O.P.) P.S.Case no.198 of 2018 , registered for offences punishable under Sections 323, 307, 328 of the Indian Penal Code.

Allegation as per FIR is that her mother was administered poisons with medicines and some treatment was meted out to the siblings of her. The petitioner happens to be father of the informant and the husband of the victim.

Submission of the learned counsel for the petitioner is that as a matter of fact overdose of medicines was injected to her due to mistake and due to that she was hospitalized. Now both the parties have compromised the case. In this case earlier

Patna High Court CR. MISC. No.79886 of 2018(3) dt.28-02-2019 2/2 notice was issued to the informant who had appeared and both the parties have jointly submitted that the matter has been compromised.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah West Champaran in connection with Bettiah Town (Kalibag O.P.) P.S.Case No.198 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition to co-operate in the trial. With the aforesaid observation, this application is allowed.
