In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 147, 148, 149, 447, 324, 307 and 302 of the I.P.C and section 27 of the Arms Act.
At the very out set it has been submitted that the petitioner was not charge-sheeted in this case and he has been summoned under section 319 Cr.P.C. to face the trial. During investigation the petitioner was found innocent and as such he deserves sympathetic consideration, to which the learned A.P.P. does not oppose.
In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months
Patna High Court Cr.Misc. No.42090 of 2014 (2) dt.22-04-2015 2/2 from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. 2nd Additional District & Sessions Judge, Buxar in S.Tr. No. 169 of 2012/ 278 of 2012, arising out of Rajpur P.S. Case No. 124 of 2005, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
