The petitioner seeks bail in Chhatauni P. S. case no. 207 of 2017 instituted for the offence under Sections 115/120B of the Indian Penal Code and Sections 25(1-A) 25(1-AA), 25(1-B), 26(II), 35 of the Arms Act. It is alleged in the written report that one AK-47 rifle and 14 cartridges have been recovered from possession of this petitioner.

Learned counsel for petitioner submits that there was recovery of one AK-47 and 11 cartridges from possession of co accused Munna Pathak who has been granted bail by coordinate Bench of this Court by order dated 12.4.2018 passed in Cr. Misc. no. 8689 of 2018 after completing one year in jail

Petitioner is in custody since 19.8.2017.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM 12th Motihari, East Champaran in connection with Chhatauni P.S. case no.207 of 2017 subject to the following conditions:

(i) Both the bailors shall be the close relative of the petitioner.

(ii) The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.
