JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner, who is a lady, apprehends her arrest in a case under Sections 406 and 420 of the Indian Penal Code. The petitioner is a Ward Member of the Panchayat. Allegation is that Mukhiya, Panchayat Secretary and this petitioner took a sum of Rs.1,20,000/- from the informant for appointing his daughter Kumari Gunja, who is handicapped, as Shiksha Mitra.

It appears that the police submitted final form in the case and recommended for initiating proceeding under Sections 182 and 211 of the Cr.P.C.

Learned counsel for the petitioner submits that coaccused Kameshwar Hazra has already been granted anticipatory

Patna High Court Cr.Misc. No.48926 of 2015 (2) dt.10-11-2015 2 / 2 bail by this Court.

In the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Sri S. K. Mishra, Judicial Magistrate, 1st Class, Sikarhana, Motihari in connection with Phenhara P.S. Case no. 15 of 2009 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
