The petitioner apprehends his arrest in connection with Chiraiya P.S. Case No.122 of 2015/G.R. No.894 of 2015 initially registered under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act and, later on, added Section 302 of the Indian Penal Code, pending in the court of the Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, Motihari, East Champaran.

The accusation is that on 09.06.2015 at about 09.30 P.M., the co-accused Bashistha Narayan Tiwary alongwith this petitioner and three unknown reached at the door of the informant

Patna High Court Cr.Misc. No.38896 of 2016 (2) dt.17-10-2016 2/2 and shot fire at the informant. Later on, the informant died in course of treatment.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected.
