The petitioner seeks bail in Kiul Rail P.S. case No. 177 of 2018 registered under Section 401/414 of the Indian Penal Code.

The informant on alarm that thieves committed theft in general bogey of Rajendra Nagar Howrah express apprehended the petitioner while he was fleeing away. From the possession of petitioner two mobiles were recovered. The learned counsel for the petitioner submits that no stolen article was recovered from the possession of the petitioner. Of course, the petitioner has got criminal antecedent but there is no material to show that petitioner committed theft of any article from the possession of any passenger. The petitioner is in custody since 25.08.2018.

No.75340 of 2018(2) dt.18-12-2018 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that no stolen article was recovered from the possession of petitioner and he has remained in jail for about four months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the lime amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway Kiul (Lakhisarai) in connection with Kiul Rail P.S. case No. 177 of 2018 subject to condition that one of the bailors shall be close relative of the petitioner.
