Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 341, 323, 304, 504/34 and 304(B) of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is father-in-law of the deceased and a handicapped person, a certificate to that effect has also been annexed to this application. It has also been submitted that the police has submitted the final form, as the allegation levelled against the petitioner not found to be true. However, learned Magistrate has taken cognizance against the petitioner. It has further been submitted that other co-accused of this case has already been granted bail by this Court vide order, dated 29.09.2016, passed in
Patna High Court Cr.Misc. No.45440 of 2016 (2) dt.15-12-2016 2/2 Crminal Miscellaneous No. 40428 of 2016.

Having heard both sides and in view of the fact that the petitioner is a handicapped person and he has got no criminal antecedent and also other co-accused of this case has already been granted the privilege of bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria, in connection with Raniganj (R.S.O.P.) P.S. Case No. 08 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on himself part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
