2. The petitioners apprehend their arrest in connection with Kotwali P.S. Case No. 362 of 2024 for the offence registered under sections 126(2), 115(2), 109, 3(5) of BNS, 2023 lodged on 06.07.2024 by the informant, Sonu Kumar.
3. As per the prosecution story, the informant alleged that the accused persons used to sell liquor/ganja and on the fateful day, armed variously, they assaulted the informant's side causing injury on the head. The Wife was also assaulted and dragged on the ground. They were taken to Jay Prakash Narayan Hospital, Gaya, which followed the FIR.

4. Learned counsel for the petitioner submits that omnibus allegation is there against the two petitioners whereas learned APP opposing the prayer submit that the allegation of not only assault is there, the reason is that they sell liquor/ganja and when they were asked to stop the same, assaulted. Further, both have criminal antecedent.
5. Considering the submissions as also the allegation coupled with the fact that the two petitioners have criminal antecedent, rejected.
