JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2020 Heard Mr. Ashok Kumar Sinha, learned counsel for the petitioner and Mr. Shailendra Kumar Singh, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Paliganj P.S. Case No. 285 of 2019 registered for the offence under Section 392 of the I.P.C.
The prosecution story as per the First Information Report is that three unknown miscreants snatched the Swift Desire Car and mobile phone of the informant on gun point. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and no incriminating or stolen article has been recovered from the conscious possession of the petitioner. Learned counsel further submits that name of the petitioner has transpired in this case on
Patna High Court CR. MISC. No.23044 of 2020(4) dt.04-11-2020 2/3 the basis of his confessional statement after his arrest in an another case being Khiri More P.S. Case No. 85 of 2019. Learned counsel further submits that two other co-accused namely, Amit Kumar and Prafull Kumar @ Praful Kumar have been granted bail by different co-ordinate Benches of this Court in Cr. Misc. No. 10378 of 2020 and Cr. Misc. No. 23514 of 2020 respectively. Learned counsel further submits that charge sheet has already been submitted in this case. Having heard learned counsel for the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 26.10.2019 and other coaccused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Danapur District-Patna / court concerned in connection with Paliganj P.S. Case No.
(i) that the petitioner shall remain present on each and every date during the
Patna High Court CR. MISC. No.23044 of 2020(4) dt.04-11-2020 3/3 course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall be liable to be cancelled.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
