JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 379 of the Indian Penal Code.
Allegation is that informant is an employee of a Construction Company and withdrew Rs. 2 lacs of the company through cheque from bank and was returning from there keeping the money in the dickey of his motorcycle. On the way, he stopped at a mobile shop and after some time he found that the money was looted breaking the dickey of his motorcycle. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 14.8.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. He is not named in the F.I.R. Suspicion has been raised against him. There is no recovery of any incriminating article from possession of petitioner.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.50518 of 2016 (2) dt.24-11-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IXth, Motihari, in connection with Motihari Town P.S. Case no. 483 of 2016.
