JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Bhagwan Bazar P.S. Case No. 33 of 2017 registered under Sections 363/366(A) of the Indian Penal Code. The accusation is that the Shreya Gupta, aged 17 years, daughter of informant had gone to market on 04.02.2017 for purchasing vegetables but did not return and, thereafter informant and her son started searching about her whereabouts. In the meantime, Bablu Alam met and told that seven accused persons including the petitioner have forcibly taken away her daughter by a Bolero. The informant has raised suspicion about
Patna High Court Cr.Misc. No.23830 of 2017 (3) dt.31-08-2017 kidnapping of her daughter for the purpose of marriage. Learned counsel for the petitioner submits that petitioners are innocent. Victim girl was having love affair with co-accused Rahul Choudhary. Her statement has been got recorded under Section 164, in which she has made allegation of rape against Rahul Choudhary and not against the petitioners but in medical report her hymen was found intact. It is further submitted that victim girl has performed court marriage at Saran, Chapra with Rahul Choudhary on 02.12.2016.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judiciial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 33 of 2017 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
