====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2019 Heard learned counsel for the petitioners, counsel for the informant and the State.
The petitioners seek bail in Noorsarai P.S. Case No. 201 of 2018, instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324, 302, 504 and 506 of Indian Penal Code.
Counsel for the petitioners submits that there is no specific allegation against petitioners in the First Information Report. There is general and omnibus allegation against all the eight FIR named accused persons including petitioners. He further submits that there is no disclosure in the First Information Report as to who was having any lethal weapon and
Patna High Court CR. MISC. No.77136 of 2018(3) dt.07-03-2019 2/2 who was responsible for causing injury to the father of the informant who died as mentioned in the written report. Counsel for the informant has appeared and opposed the prayer for bail.
In post mortem report the Doctor has found swelling on back of skull (head) and injuries on right arm and left leg.
From the written report it appears that general and omnibus allegation has been levelled against the petitioners. Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with in Noorsarai P.S. Case No. 201 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners.
