The petitioner apprehends his arrest in a criminal prosecution registered under Sections 307, 406, 420, 120B and some other allied offences under the Indian Penal Code as also under Section 27 of the Arms Act.
Taking into consideration the fact that the petitioner is specifically alleged to have participated in the commission of the crime in question and also taking into consideration the fact that he is accused in two more criminal cases of almost identical nature, which is mentioned in paragraph 3 of this anticipatory bail application, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Jankinagar P.S.Case No. 101 of 2016 pending in the court of the learned Chief Judicial Magistrate, Purnea is rejected. However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered on its own merits without being prejudiced by the present order.
