JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in Triveniganj P.S.Case No.80/16 for the offence under Section 304(B)/34 of the I.P.C.

Allegation of the informant is that the daughter of the informant Ranju Devi was married with Rajesh Yadav before five years and out of their wed lock two daughters were born namely, Priyansu Kumari and Priyanka Kumari. Due to nonfulfillment of dowry demand the daughter of the informant was being tortured and she was assaulted and killed by administering poison (thaimat).

Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.18148 of 2017 (4) dt.07-08-2017 2/2 petitioner submits that the petitioner is mother- in -law who has falsely been implicated in this case. Moreover, Rajesh Yadav who happens to be the husband of the deceased is in custody since 6.8.2016.

On the other hand, learned A.P.P. opposed the prayer for bail of the petitioner with submission that the petitioner appears to be mother-in-law of the deceased. Fax copy of the Forensic Science Laboratory report reveals that thaimat was detected.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Supaul, in Triveniganj P.S. Case No.80 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Rajendra Kumar Mishra, J) AnilKrSinha/- U
