2. Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 316(2), 317(2), 352, 351(2), 3(5) of the BNSS, 2023.
3. The allegation against the petitioner is that when the informant went to him to demand Rs. 1,00,000/- which he had paid as advance against agreement for sale, the petitioner is alleged to have refused to return money and along with others he is said to have assaulted the informant and her partner Rambali Singh and Niranjan Singh. The learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case. It is also submitted that there is nothing on record to suggest that petitioner had taken
Patna High Court CR. MISC. No.23762 of 2025(2) dt.05-05-2025 2/2 any advance from the informant and that the entire story is concocted. It is next submitted that petitioner is a person with clean antecedent.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the aforesaid facts and circumstances of the case, the petitioner in the event of his arrest or surrender within four weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., IInd Patna City in connection with Fatuha P.S. Case No. 823 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 .
