JUSTICE RAMESH KUMAR DATTA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners pray for anticipatory bail in a case under Sections 420,465, 467, 469, 471, 149, 120(B) and 34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioners that the allegation against the petitioners is of having filed an unregistered Yadast Ladavinama with the forged signature of the informant in Title Suit No. 186/1988 pending in the court of Munsif, Manjhaul, Begusarai. It is urged by learned counsel that with respect to the same document, an application under Section 340 Cr.P.C. filed by the informant has been

It is also submitted that the title suit is still pending and by misusing the contacts and communications of the petitioners, the details of which have been mentioned in the anticipatory bail application, several police case, etc., have been filed in order to harass these petitioners who are agnates and senior citizens of the informant.

It is also submitted by learned counsel for the petitioners that the petitioners have no criminal antecedent except one criminal case filed by the son of the informant which is part of their scheme to harass and disturb the petitioners. On a consideration of the facts and circumstances of the case, it is directed that the petitioners, 1. Ramashish Prasad Singh and (2) Smt. Bina Devi @ Bina Devi, in the event of their arrest/surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with C.B.R. (Majhaul) P.S. Case No. 178 of 2014 to the satisfaction of the Additional Chief Judicial Magistrate, Manjhaul, Begusarai, subject to the other conditions as laid down under Section 438(2) Cr.P.C.
