JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Bahera P.S. Case No. 283 of 2016 registered under Section 47(a), 54 and 53(b) of the Excise Act.
The accusation is of recovery of two bottles, each containing 180 ml, of Indian made foreign liquor, from the pocket of the petitioner.
Learned counsel for the petitioner submits that petitioner is in custody since 26.09.2016.
Having considered the small quantity of recovery of liquor and the period of custody, the petitioner above named, is directed to be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.212 of 2017 (2) dt.12-01-2017 Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Dharbhanga, in connection with Bahera P.S. Case No. 283 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
