JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-10-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Ms. Anita Kumari Singh, the learned APP for the State.
The present petition for grant of regular bail is a second attempt at the behest of the petitioner herein in connection with Muffasil P.S. Case No. 71 of 2015 under Sections 447, 341, 324, 307, 504/34, 302 of the Indian Penal Code and Section
Patna High Court CR. MISC. No.25567 of 2020(2) dt.05-10-2020 2/3 27 of the Arms Act inasmuch as the earlier petition filed by the petitioner for grant of bail was dismissed by a coordinate Bench of this Court vide order dated 14.3.2019 passed in Criminal Miscellaneous No. 71905 of 2018.
The petitioner is alleged to have fired gunshots on the deceased resulting in his death. The learned counsel for the petitioner has submitted that the petitioner is innocent and he has not committed the offence, as alleged. It is further submitted that there is no progress whatsoever in the ongoing trial and the petitioner is languishing in custody since 15.5.2018.
Per contra, the learned APP has vehemently opposed the prayer for bail.
I have heard the learned counsel for the parties and I find that there is no change in circumstance, from the day the prayer of the petitioner for grant of bail was rejected, till date, hence, I do not find any reason to reconsider the prayer for bail of the petitioner herein, especially in view of the heinous crime of murder committed by
