The petitioner seeks bail in a case registered under Sections 419, 420 of the Indian Penal Code and Sections 18(c), 18(A), 18(B), 27(b)(ii)/28, 28A, 36 AC of Drugs and Cosmetics Act.

The prosecution case in brief is that on raid made by the Drug Inspector, expiry and intoxicated medicines were recovered from the shopping complex of the petitioner. It has been submitted on behalf of the petitioner that the petitioner has got no antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 08-01-2019. Charge sheet has already been submitted. The petitioner has been made accused

Patna High Court CR. MISC. No.21977 of 2019(2) dt.18-04-2019 2/2 in the present case due to mistake of fact. The petitioner has got no concern with the medical shop in question. Neither he is owner nor the employee of the said shop. He was just passing by the shop and due to mistake, he has been made accused in the present case.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with N.T.P.C. P.S. Case No. 06 of 2019.
