2. The petitioner seeks bail, who is in custody since 10.12.2024, in connection with Meenapur P.S. Case No. 413 of 2022, FIR dated 17.08.2022 registered for the offence under Sections 147, 148, 149, 341, 323, 506, 302, 120B of the Indian Penal Code and under Section 27 of Arms Act.

3. According to the prosecution case, the informant alleged that the petitioner along with other co-accused persons opened fire upon them.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It appears from the FIR that the informant is not the eye witness of the present occurrence and on the basis of confessional statement of co-accused person the name of petitioner has transpired

Although there is specific allegation against the petitioner that he alongwith other co-accused person have fired upon the victim and the victim received bullet injury and he died subsequently. The petitioner is rotting in judicial custody since 10.12.2024.

Learned A.P.P. for the Statehas vehemently opposed the prayer for bail of the petitioner and submits that there is specific allegation against the petitioner that he alongwith other accused persons fired upon the victim and apart from that petitioner carried twelve criminal antecedents other than the present one.

6. Considering the facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Meenapur P.S. Case No. 413 of 2022 pending in the Court No.08 Learned J.M.-1st Class (East), Muzaffarpur.

7. Prayer is refused.

8. However, when the charge has been framed against the petitioner then the petitioner may move for renewal of his prayer. (Rajesh Kumar Verma, J) Suruchi/- U T
