The petitioner prays for anticipatory bail in a police case registered under Sections 272 and 273 of the Indian Penal Code and Section 47 (A) of the Bihar Excise Act.

Learned counsel for the petitioner submits that 33 bottles of 200 ml. country made liquor have been recovered from the house of the petitioner. It is further submitted that the petitioner was not present when the alleged search was made and nothing has been recovered from the conscious possession of the petitioner. It is stated that the petitioner does not have any criminal history.

On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Shashi Kushwaha alias Shashi Kant Kushwaha, in the event of his arrest/surrender in the

No.46825 of 2015 (3) dt.03-12-2015 court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each in connection with Buxar (Industrial) P.S. Case No. 175 of 2015 to the satisfaction of the Chief Judicial Magistrate, Buxar, subject to the other conditions as laid down under Section 438 (2) of the Cr.P.C.
