Petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 524 of 2016 registered under Sections- 409, 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present case has been lodged in retaliation at the instance of one Madan Kumar as he was arrested taking bribe in paddy procurement and this petitioner was a witness to the said trap. In fact BSFC on receiving the paddy used to directly transmit the money to the District Cooperative Bank, Lakhisarai. Subsequently, District Cooperative Bank used to make payment to the farmers. No amount was ever given to the PACS of
Patna High Court Cr.Misc. No.26374 of 2017 (2) dt.06-06-2017 2/2 which petitioner was the Chairman. In the enquiry report, it is stated that there was no irregularities in the procurement of paddy but there was some irregularity in procurement of wheat. It is further mentioned that there was no man like Raj Kumar Singh whereas from the Voter List (Annexure-4) it is evident that he is resident of Mahsona.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 524 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
