The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code.

The prosecution case is that the accused persons variously armed came to the house of the informant and started abusing the informant. On protest being made by the father of the informant, the petitioner gave a brick blow on the face of the father of the informant.

It is submitted by learned counsel for the petitioner that the injury has been found to be simple superficial in nature. It is further submitted that there is no accusation of repeating the blow. A statement has been made in paragraph no.3 of the

Patna High Court Cr.Misc. No.76278 of 2018(2) dt.17-01-2019 2/2 petition that the petitioner is not having any criminal antecedent. It is submitted by learned APP for the State that there is specific accusation against the petitioner.

Considering the nature of assault and the nature of injury caused to the father of the informant found to be simple superficial in nature, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IVth, Danapur, Patna in connection with Bikram P.S. Case No. 159 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
