====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Kishanganj P.S. Case No. 221 of 2018 registered under section 365, 354/34 of IPC.

The allegation against the petitioner, as per the first information report, is that the petitioner along with other coaccused persons abducted the daughter of the informant with oblique motive.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as the statement of the victim girl was recorded under Section 164 of Cr.P.C in which she has not stated anything

Learned counsel further submits that from perusal of the first information report itself it would be evident that except the name of the petitioner being added there no other charge has been tagged against him.

Having regard the submission made by the parties and taking into consideration the fact that in her statement under Section 164 Cr.P.C, the victim girl has not disclosed anything against the petitioner, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 221 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
