The petitioner apprehends his arrest in Vaishali P.S. Case No. 225/2016, registered for the offences punishable under Sections 379, 504 and 34 of the Indian Penal Code. The informant alleged that the petitioner came on a motorcycle along with two other accused persons and stopped near the house of the informant. Thereafter, the petitioner started the motorcycle of the informant and fled away.

Learned counsel for the petitioner submits that the petitioner is a barber. Some altercation took place for wages and that is why petitioner has falsely been implicated in the case, but it appears from the F.I.R. and the case diary that the informant saw the petitioner fleeing away with his motorcycle. Patna High Court Cr.Misc. No.24304 of 2017 (3) dt.14-07-2017 2/2 have also reiterated the same facts that the petitioner fled away with the motorcycle of the informant.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
