ANJANA MISHRA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the Bihar State Power Holding Company Limited as well as learned counsel for the State. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 135 of the Electricity Act.

Learned counsel for the petitioner submits that the entire procedure of seizure has been made against the mandatory provisions of law. With regard to seizure-list, it is further submitted that only electric-wire has been recovered and there is no house or building existing in the name of the petitioner and no specific place of occurrence has been mentioned in the First Information Report.

Patna High Court Cr.Misc. No.47005 of 2015 (4) dt.29-02-2016 P2/2 Considering the nature of allegations made and seizure referred to, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Chousa P.S. Case No. 80 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
