Petitioner is seeking anticipatory bail in connection with Pirbahore P.S. Case No. 517 of 2018 registered for the offences punishable under Sections 419, 420, 482, 467, 468, 471 and 472 of the Indian Penal Code, Sections 63 and 64 of the Copyright Act and Sections 103 and 104 of the Trademark Act. Learned counsel for the petitioner submits that, in the present case, the allegation against the petitioner is that he was passing of duplicate bags under name and style of 'Fastrack' which is a trademark reserved by firm of the informant. Patna High Court Cr.Misc. No.76180 of 2018(2) dt.21-12-2018 2/2 consequence as the informant may be entitled for monetary compensation in terms of the provisions of the Special Statutes. No one appears on behalf of the State to oppose this application.
In the given facts and circumstances where it is the submission of the petitioner that the claim of the informant is disputed and the informant will have a remedy in civil law, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned C.J.M., Patna in connection with Pirbahore P.S. Case No. 517 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond.
