====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 18.10.2017 in a case for the offence registered under Sections 20 (C), 25, 8 of N.D.P.S. Act, 25(1-b) a, and 26 of the Arms Act. The prosecution story, in brief, is that 5 Kg. Ganja, one country made pistol alongwith twelve live cartridges is alleged to have been recovered from the room of cattle shed of the petitioner.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses

Patna High Court CR. MISC. No.22491 of 2019(2) dt.12-04-2019 2/2 alleged against the petitioner. 5 Kg. Ganja, one country made pistol alongwith twelve live cartridges is alleged to have been recovered from the room of cattle shed of the petitioner. The alleged Ganja is below the commercial quanity. There is no compliance of Sections 42 and 50 of the N.D.P.S. Act and Section 100 of Cr.P.C.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-I, Samastipur, in connection with N.D.P.S. Case No. 2/18+ N.D.P.S. Case No. 5/18, arising out of Musrigharari P.S. Case No. 119 of 2017.
