Heard learned Sr. Counsel with counsel on record for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
The petitioner seeks regular bail in connection with Women P.S. Case No. 70 of 2019 (G.R. No. 2602 of 2019) lodged under Sections 376, 420, 427, 504, 341/34 of the I.P.C. Learned counsel for the petitioner submits that vide order dated 03.07.2020, provisional bail has been granted so that after release of the petitioner, possibility of marriage between the petitioner and victim could be explored.
Learned counsel for the petitioner submits that till
Patna High Court CR. MISC. No.21421 of 2020(5) dt.26-09-2022 2/2 date, possibility of marriage between the petitioner and victim could not be explored but it is always open between them. Learned counsel for the State kept mum on this issue but submits that allegation of Section 376 is there in the F.I.R. Learned counsel for the informant submits that there is no offer of marriage on the side of the petitioner and it is basically misuse of provisional bail. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted provisional by this Court vide order dated 03.07.2020 is hereby confirmed.
With this observation, the bail application stands disposed off.
