Having regard to the fact that the petitioner nos. 1 and 4 had criminal antecedent but in the application filed for bail, this fact was either not stated due to lack of knowledge of the case pending now before the Gram Kutchery or even otherwise, this Court is not inclined to modify the earlier order dated 19.08.2015 in Cr. Misc. No. 21295 of 2015.

In the result, the prayer for grant of anticipatory bail to the petitioners no. 1 and 4 is hereby recalled and they are directed

Patna High Court Cr.Misc. No.46037 of 2015 (2) dt.04-11-2015 2/2 to surrender before the court below whereafter their prayer for regular bail shall be considered on its own merits without being prejudiced by anything said in this order.
