The petitioner apprehends his arrest in Ashok Paper Mills P.S. Case No. 63 of 2014, registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire First Information Report has been drawn up merely on the basis of suspicion that since these persons were also working at the site in question where the deceased was found dead, the persons so named had participated in the occurrence. Learned counsel for the petitioner submits that save and except the fact that it has being stated in the First Information Report that petitioner Bhola Mishra was also found in a drunken state at the place of occurrence, there is no other cogent evidence to implicate him in connection with the present
Patna High Court Cr.Misc. No.48993 of 2014 (2) dt.23-04-2015 case.
Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedent, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga at Laherisarai in connection with Ashok Paper Mills P.S. Case No. 63 of 2014, subject to the conditions as laid down under Section 438(2) of the Indian Penal Code. (Anjana Mishra, J) P.K./- U T
