JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This is an application for grant of anticipatory bail in connection with Piar P.S. Case No. 148 of 2017, disclosing offences under Sections 363, 376, 511, 120(B), 34 of the Indian Penal Code Sections 4/6/7/8/12/17&18 of the POCSO Act. Allegation against the petitioner and other accused persons is that they have lifted the daughter of the informant and try to outrage her modesty and when she raised Hulla, then the informant with his family members reached there. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the statements of all the witnesses have not supported the case. Heard learned A.P.P. also.

Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant

Patna High Court Cr.Misc. No.1258 of 2019(2) dt.18-01-2019 2/2 anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit and will pass an appropriate order, if possible on the same day.
